Expert NO. 51241 – General Contractor Expert Witness, Southern California

“I’ve been managing construction projects for a little over 29 years. I’ve managed projects for general contractors, and as a consultant representing public Owners overseeing Contractors, mostly on public works projects.

I’ve dealt with at least 30 delay claims in various capacities:

  • Prepared the delay analysis, submitted and negotiated as a Project Manager for Contractors.
  • Reviewed and negotiated delay claims, submitted by Contractors to me as an Owner’s representative.
  • Prepared and presented delay analysis as an expert witness.
  • Prepared several training classes for other construction managers covering delay analysis and principles of scheduling I am an experienced scheduler for 15 years. Scheduling is the main tool, but delay analysis requires a wider range of construction management experience, an in depth experience of the daily events on site and the various documents used on a project. Performing a delay analysis will require a lot of judgment calls and understanding of the reliability of each type of construction document.

Having over 29 years of hands on management of projects provided me the needed background to perform this complicated task of delay analysis. When I meet with clients, I can relate to the issues that they describe first hand which allows me to focus on the right issues that save costs to the clients, as it is very easy for an inexperienced analysis to over work the task.

By education I am a civil engineer and a certified construction manager by CMAA.”

“I am an employment attorney and extremely familiar with the legal issues involved with deducting the value of meals from employees’ paychecks. I have substantial advice and counsel experience on this unique issue, and I have also litigated — both in single plaintiff and class action cases — multiple wage and hour cases, including a class action just this year which involving meal period deductions for employees.

Finally, I have served as an expert witness multiple times. Thus I am familiar with the rigors of the process and the importance of being available, flexible and meeting deadlines. Expert NO. 55741 – General Contractor Expert Witness, California

“I have an extensive background relating to culling bids on commercial projects which plaintiff clearly specializes in. Matters pertaining to rejection of bidders are myriad and go far beyond simple cost factors. The determining factors range from petty personality issues to more complex background review of subs which can reveal to the Prime Contractor potential liabilities and previous indiscretions on the subcontractors part.

With certainty I can review the related documents in a case and will likely illustrate the need for completion deadlines with penalties and other requirements regarding ability to perform and these considerations may have played a roll. Prudent building contractors are highly concerned about their exposure to liability in California’s litigious climate and previously satisfied claims against a sub may strike a sour note.

I can opine on increased labor cost due to a settled work comp claim. I provide expert opinion on the imposition of materials, equipment, scaffold, and etcetera in the bid formula.”

Expert NO. 324840 – Engineer expert in Robotics, Mechatronics, and Automated Control Systems

I have over 12 years of combined industrial and academic experience in sensing, sensor technology, controls, mechatronics and actuation mechanisms. I hold a PhD in engineering and am an engineering professor where I teach and conduct research at the university level on operational/functional aspects related to sensing technologies design and implementation in a closed-loop control scheme. I have authored and co-authored over 60 peer-reviewed articles related to the required field of expertise including patents, books, journals articles and conference proceedings papers. I served as a Principal Investigator on Department of Defense and Department of the Navy funded projects. I am also a senior member of the Institute of Electrical and Electronics Engineers (IEEE) and member of the American Society of Mechanical Engineers (ASME).

Loop sensors are typically a single channel inductive loop detectors (typically buried in the ground) which are based on the changes in the inductance that are caused by metal parts of a vehicle. These signals are then picked up & evaluated by a microprocessor (a computer) and when operation voltage is applied, its calibrations becomes automated thus resulting in ease of use. Applications include parking barrier control, vehicle counting, automated gates and doors, rising bollards, and industrial control systems. The design, analysis and integration of induction-based sensors (and other types) is my expertise. Understanding how these loop sensors work and integrated is only one step in the process of analyzing the cause of the issue at hand. This also requires knowledge of the electromechanical design aspects of the barrier which is controlled by this sensor in a closed-loop control system.

Expert NO. 376326 – Mobile Phones, Electrical Engineering, Design Engineering, Pennsylvania

I did design and R&D for mobile phones in the 90s and the next decade, while employed by AT&T Bell Laboratories, Lucent Technologies and Agere Systems. The early and mid-nineties were the years during which the US Cellular System was beginning to launch Personal Communication Service (PCS), later renamed to its worldwide acronym GSM (for Groupe Speciale Mobile). During those years I was doing research on mobile phones and the world-wide cellular system – studying the literature and taking formal graduate-level courses – in preparation for my later career change from hard-disk-drive electronics to cellular radio electronics.

I became directly involved as the US and world-wide GSM system evolved from to the so-called 2½ – G generation. Therefore, my practical knowledge from research and design spans the later stages of time-division multiple access (TDMA) and frequency-division multiple access (FDMA) through generations 2 and 2 ½ of GSM, to the early days of code-division multiple access (CDMA). Very recently (2012), I began systematically preparing to expand my consulting practice into expert witnessing with an eye toward patent analysis and litigation.

Expert NO. 372336– Wireless Systems, Electrical Engineering, Southern California

I was a Professor of Electrical Engineering a University and I was performing research into many of the fundamental technologies that were evolving into the wireless telephony standards. I am a practicing wireless system engineer and have been since 1976. I hold a Ph.D. in Electrical Engineering from the University of Utah and held a full-time professor position in the Department of Electrical Engineering from 1989 to 1994. During those years, while I was not actively designing wireless telephony systems, I was very active in the technological areas that were becoming part of telephony standards. Some examples:

GSM was introduced in 1991 and there was considerable interest in evolving GSM baseband processing to handle fading channels. I had a research contract and a subsequent consulting contract to investigate this problem.

IS-95 was evolving during the early 90’s eventually becoming the dominant 3G technology. My research from 1987 through approximately 1997 was in the area of CDMA multiuser receivers. Of course CDMA is the fundamental technology used by IS-95, UMTS, and many other 3G systems.

I followed the wireless telephony standards closely since it was so intertwined with my own research activities and gave occasional tutorials on the subject to industry groups. I have a fair amount of patent-specific experience including testimony in Federal District Court, infringement analysis, etc.

For over 20 years, as a supplier manager and executive, I constantly dealt with distributors. For two years, I served as a senior vice president of sales and marketing, and later as a president of a $100 million industrial distributor.

During the past decade, I have consulted to suppliers and distributors regarding relationships and distribution agreements. During that same decade, I have engaged as an expert witness in cases for both suppliers and distributors involving allegations of breach of contract. As a consultant, I create and negotiate distribution agreements for both distributors and suppliers.

For several years, from an office in Tokyo, I managed all sales and marketing functions throughout the Pacific Rim for an American manufacturer. During that time, I made quarterly trips to Korea to meet with customers, distributors and manufacturers’ representatives.
