Expertise DescriptionI have more than 40 years of experience in the commercial insurance industry with expertise in the customs and practices of the Bermuda Excess Liability insurance market, and the use and interpretation of the so-called Bermuda Excess Liability Application and Policy form. I have an in-depth appreciation and knowledge of the insurance agent/broker relationship, insurance standard of care for agents and brokers, and in determining whether or not the agent/broker has met their standard of care due the client under state law. I have additional knowledge of insurance industry custom and practice, cases involving insurance broker errors, brokerage malpractice, and omissions claims, property damage/business interruption, insurance disputes, and insurance agency breach of contract disputes. I have over 10 years expert witness experience with consultations, deposition, and courtroom testimony.

My expert witness experience includes cases of insurance agent/broker failure to meet standard of care due client; property/business interruption insurance coverage for hurricane damage; insured's failure to properly answer Bermuda Excess Liability Renewal Application e.g., fraud and misrepresentation; coverage interpretation of Bermuda Excess Liability policy, e.g., Notice and definition of an intergraded occurrence claim; and breach of insurance agency non-compete agreement.
My consulting experience includes insurance coverage for a chemical company in a railroad Final Offer; and analysis of worldwide insurance coverage option for the Chemical and Pharmaceutical Industries.
My professional experience includes being an Insurance Consultant, as well as prior experience as Senior Vice President and Global Practice Leader in the chemical and Pharmaceutical industries, Director of Risk Management, and Assistant Risk Manager.
During my many years as an insurance broker, consultant, and risk manager, I placed Aviation Liability and Property Damage insurance on many occasions. Therefore, I am familiar with the policy insuring terms and conditions. In addition, as an insurance expert witness, I have worked on cases where the insurance company pleaded for misrepresentation and/or rescission of the insurance policy due to the policy holders’ response to application questions and/or failure to abide by warranty provisions in the policy.
I have extensive underwriting experience with the chemical and pharmaceutical industries, which together with the oil and gas industries, are the most hazardous categories considered by insurance underwriters.
I am very familiar with the Evanston Environmental Impairment Liability (EIL) insurance policy form, having worked with this form as a corporate risk manager, insurance broker, and insurance consultant.
I don’t meet counsel’s requirement of having served as a former ISO employee, but since the mid 1960’s I’ve worked as an insurance broker, insurance consultant, insurance expert witness, and corporate risk manager (see attached exhibits), dealing with insurance policy cancellations involving the short rate and pro rata cancellation tables. This exercise involved my clients and my various employers as cancellations were triggered by both the policyholder and or the insurer. From my experience, there was no other mechanism in the policy terms and conditions other than the short rate and pro rata table to determine the return premium. I also recall this subject being part of the curriculum that I studied as I prepared to take the ARM and CPCU insurance professional designation examinations.
