Expertise DescriptionWith more than 35 years of experience in all areas of the Commercial Real Estate field, my career has been especially focused on landlord-tenant disputes, move-out condition, property management, due diligence, and 1031 exchange, among other related topics. I have spent time as a commercial real estate expert witness in California and have provided consultations, deposition, and courtroom testimony to numerous clients.
Areas of Expertise
My expert witness experience includes opinion on the premises condition upon tenant move out, breach of purchase agreement by seller, tenant breach of lease monetary default as well as interference in business by third party, and dispute between landlord and tenant regarding landlord’s continuing operation of tenant’s business after tenant’s default.
My consulting experience includes countless matters related to investment analysis and forecasting, lease terms, acquisition and disposition strategies, renegotiating existing leases in contracting economic conditions, and 1031 tax deferred exchanges. Also including consulting with Chinese governmental officials on the use restrictions on real estate and ongoing replacement reserves.
My professional experience includes over 35 years of diverse real estate experience, including asset management, investment brokerage, and property management. I have either managed, leased, or brokered over 100,000,000 square feet of commercial property including all types and classes of office buildings, medical offices, multi and single tenant industrial and flex parks, and both neighborhood and strip retail centers. My
residential experience includes over 20,000 units. I have also worked as an independent Asset Manager, Property Manager, leasing agent, and brokerage representative for select clients in California and Texas. I have acted as a fee-based consultant for investors and have taught a class in commercial real estate investment. In addition, I am qualified as an expert witness with the Orange County Superior Court and offer expert witness services throughout the Southern California area.
For several years I established from the ground up an HOA management firm with approx 40 HOA's, over 4,500 units handling all types of HOA disputes. I was a guest speaker on the topic of HOA management at a university class. I was invited to China to teach government officials about HOA management operations. I have consulted several times on HOA disputes. I have had extensive experience with purchase/sale of California properties with environmental issues and the due diligence process of disclosures between the buyer, seller, agents' industry standards of care in this regard.
I have extensive experience in both asset and property management for apartment complexes of varying sizes in both California and Texas. In addition, I have experience teaching a CA BRE approved course in commercial real estate that covers property management. I have opined on tenant-landlord cases and property management standard of care cases as well.
I have substantial hands-on experience with apartments at all levels including supervisory and training and Asset Management (managing the property managers). I have a solid reputation in the real estate business and I have earned the respect of my clients and peers in every transaction or assignment I have been involved with. I am comfortable, clear, honest, alert, and concise during court and/or deposition testimony. As an Expert Witness, I have received very favorable comments along the way from the clients and the attorneys I have been retained by. And my testimony stands up well in situations where an opposing expert offers a differing opinion, as well as highlighting key issues from the depositions of the other involved parties.
I have substantial past experience with SFR management. I am well qualified to opine on the industry standards related to self managed property, and property conditions which are the responsibilities of the landlord or the tenant, and the resulting diminished value related to substandard conditions.
I am qualified to opine on the standards of care regarding real estate disclosures. While I have had properties under contact in Nevada, I have yet to close on one in that state. But I did go through the due diligence process for a Nevada property. In a recent case my deposition was a key element in the parties settling. This was in a state where I had not before closed a transaction and the opposing counsel made an effort to use that to discredit my testimony.
