These experts are well-versed with the federal Fair Debt Collection Practice Act and have assisted law firms with litigation issues concerning various provisions on the Act. These include debt collector communications with debtors, harassment, collection agency advertising, false or misleading representation, acceptable fees, and other types of abusive, unfair, or deceptive practices to collect debts from consumers. In addition, they assist attorneys with issues of wage garnishment and locating debtors. Others have worked on legal actions by debtors for violations of the Act.
Our experts have worked with the Federal Trade Commission (FTC), which enforces the Fair Debt Collection Practices Act (FDCPA), state Attorney General’s office, and the Consumer Financial Protection Bureau. In addition to the federal Fair Debt Collection Practices Act, many states have their own specific debt collection laws, which may be more protective of consumers. These state laws are not considered inconsistent with the FDCPA.
