ForensisGroup Telephone Consumer Protection Act (TCPA) Expert Witnesses have backgrounds in this act of Congress that was in response to the growing number of telephone marketing calls in the early 1990s.
The TCPA restricts the placing of telemarketing calls and the use of automatic telephone dialing (auto-dialing or robocalling) systems and artificial or prerecorded voice messages.
In addition, the rules adopted to implement the TCPA included the requirement that entities making telephone solicitations institute procedures for maintaining company-specific do-not-call lists. In 2012, the FCC revised its TCPA rules to require telemarketers to obtain prior express written consent from consumers before robocalling them; to no longer allow telemarketers to use an “established business relationship” to avoid getting consent from consumers when their home phones; and to require telemarketers to provide an automated, interactive “opt-out” mechanism during each robocall, so consumers could immediately have the telemarketer stop calling.
Litigation concerning the TCPA has seen allegations of companies making unauthorized calls using autodialing systems in nonemergency situations to cellphones. Nationwide classes of customers have received these calls designed to market and sell the company’s products and services. In another action, a plaintiff alleged that a company violated TCPA rules and placed unsolicited telemarketing calls to his cellphone using an automatic dialing system without the customer’s consent. It was revealed that another company gave his number to the telemarketer and failed to disclose anything regarding sharing its customers information to third-parties.
