Expertise DescriptionI have over 20 years of experience in forensic accounting. I have expertise in accounting and tax in real estate partnership LLC, tax aspects of real estate syndication, and all areas of tax planning, tax returns, and taxation. I have also testified in the area of accountant malpractice and accounting fraud, and have prepared expert reports and analysis in cases involving the calculation of lost profits. I have assisted attorneys in cases involving partnership disputes that required an analysis of partner capital accounts to determine their correct balances. In addition to being an expert witness, I have a regular accounting practice where I am the accountant for industries such as real estate, entertainment and distributors and manufacturing. I have more than 20 years of expert witness experience with consultation, deposition, and courtroom testimony.
Areas of Expertise
My expert witness experience includes accounting malpractice and fraud, loss of future earnings calculations, present value and lost profits analysis, and I have provided both consulting and expert witness work in connection with a forensic accounting case involving the tracing of funds in connection with an asset protection program. This involved the analysis of multiple entities, including ones that were off-shore, and an analysis of alter-ego. I have testified in a palimony case where the issue was the ownership of real property and a division of lawsuit damages. I assisted an attorney in developing a theory of damages relating to a case involving finders fees. I also assisted an attorney in a case involving fiduciary accounting. I helped the attorney develop agreements in explaining the difference between fiduciary and tax accounting.
I have been practicing public accounting since 1975. I got my accounting/auditing experience working for large national accounting firm. The firm had 13 offices nationwide and our specialty was representing real estate entrepreneurs. Our clients included developers and operators of both residential and commercial real estate properties. We also represented mortgage bankers and REITS.
In addition to auditing and tax services, we provided management consulting services to the real estate profession. I personally was involved in consulting engagements relating to the computation of common area maintenance charge calculations (CAM), both from the landlord’s point of view and the tenant point of view…I represented the landlord where their tenants challenged the calculation of CAM charges. Not only would we review the calculation itself, we would also review the profit and loss statements to determine whether certain expense accounts we properly (or not properly) included.
Today, I am a partner in a large local CPA firm. I have 7 other partners and we have 30 professionals as well as bookkeepers and support staff. All in all, we have almost 60 employees. Our industry specialty continues to include real estate. We represent operators of both residential and commercial real estate properties, including both office and retail space. I have also participated in several litigation support engagements and am comfortable not only in preparing for but also offering court testimony.
