Expertise DescriptionI have more than 40 years experience in the field of Marketing with expertise in trademark surveys, brand equity, antitrust, and branding. I have experience with conducting and reporting the results of surveys regarding intellectual property issues, also rebutting such surveys. I have also been involved in surveys used in patent infringement cases as the basis for calculating damages, since the Courts often now require evidence that a patented component or feature contributes to purchase decisions and are considering survey evidence of proportional contribution. I have also been engaged as a marketing expert to assess a variety of issues, such as: business-to-business marketing, whether a claim of economic harm from exclusion from a director is or is not valid, whether a design is or is not generic, whether the use of a term in a promotion is or is not simply puffery, and whether an advertisement is or is not deceptive. I have over 20 years expert witness experience with consultations and deposition.
Areas of Expertise
My expert witness experience includes survey of fast food eaters regarding their patronage of other outlets of a franchise if one outlet of that franchise provided a negative experience, analysis of damage to a real estate company based on exclusion from a directory, analysis of whether consumers distrust other psychiatric hospitals based on the negative reputation of one such hospital in their city; analysis of the effectiveness of a bar's radio advertising after a patron of the bar was involved in a fatal accident; analysis of whether a design is generic or specific to one retailer; and analysis of whether a survey claiming to show deception by an advertiser's catalog was a valid survey.
My consulting experience includes having prepared marketing plans for two major hospitals in a medical center; served as project director for a multi-client, multi-years survey seeking data on awareness of and impressions of hospitals; and conducted marketing seminars for professionals in healthcare, managers from a ranger of industries, and also oil jobbers.
My professional experience includes being a Professor of Marketing and Entrepreneurship, as well as prior experience as a Professor of Marketing, Assistant Professor of Marketing, Faculty Fellow, Director of PhD Programs, Director of Health Care Marketing, Coordinator, and Assistant Dean and Director of Undergraduate Programs.
