Expertise DescriptionI have more than 30 years of experience in Wage and Hour matters. I served as both an investigator/compliance officer and manager enforcing and resolving a wide range of issues. Since leaving federal service, I have been consulting to attorneys and their clients on a wide variety of compliance matters. I am experienced in the Fair Labor Standards Act, Davis Bacon and Related Acts, Service Contract Act, and the H-1B employment requirements under the INA. I have served as a court mandated independent compliance monitor. I have prior expert witness experience with consultations and deposition.
Areas of Expertise
My expert witness experience includes expert reports, affidavits, declarations and depositions concerning wage and hour procedures, interns and the employment relationship under the FLSA, exceptions to overtime such as the 541 Executive, Administrative, Professional and Outside Sales exemptions, the 7(i) sales exception and the 7(k) police and fire exceptions; proper computations of overtime where the regular rate is affected by inclusions, exclusions and offsets as well as the use of the fluctuating workweek method of pay.
My consulting experience includes assisting attorneys and their clients comply with the federal wage laws. Most often I am called upon to review and advise on 541 exemptions from minimum wage and overtime in a variety of industries such as higher education, medical and pharmaceutical services, retail, property management, utilities and human service organizations, both small businesses and Fortune 500 companies. I also reconstruct hours of work and recalculate overtime in accordance with the regular rate principles. In the prevailing wage arena, I have mapped employees onto the government stipulated job classifications and verified that the proper rates are being used in accordance with the CFR, FAR and construction and service contracts, and in the case of H-1B workers, the required wage rates.
My professional experience includes a federal career that exposed me to thousands of investigations and their common and unique issues and being a self employed wage and hour compliance consultant since 2007. As a consultant I have also been engaged as a subject matter expert and as a court appointed monitor.
